Version 1.0 — DRAFT FOR LEGAL REVIEW · Effective date: [TO BE SET ON COUNSEL APPROVAL]
1. These terms
These terms govern your use of the Mulga Money website and online platform (together, the "site"). By using the site you agree to them. They sit alongside — and never override — any lease agreement you enter with us: if there is any inconsistency, your lease agreement prevails for matters it covers, and nothing in these terms limits your rights under the National Consumer Credit Protection Act 2009, the National Credit Code or the Australian Consumer Law.
2. Who we are
The site is operated by Mulga Finance Pty Ltd (ABN 18 689 117 995), trading as Mulga Money, holder of Australian credit licence 573780. Contact: hello@mulgamoney.com.
3. Information is general only
Content on the site — including pricing examples, guides and FAQs — is general information. It does not take account of your personal circumstances and is not financial, legal or tax advice. Whether a lease suits you is assessed individually when you apply; approval is never automatic.
4. Your account
You must give accurate information when you register and keep it up to date. Keep your password secret and your authenticator device secure; you are responsible for activity under your login until you tell us it may be compromised (email hello@mulgamoney.com immediately if you suspect that). We may suspend an account to protect you or the platform while we investigate suspicious activity.
5. Acceptable use
You must not: use the site for any unlawful purpose; provide false or misleading information in an application; attempt to access another person's account or data; probe, disable or overload the site; scrape the site; or upload malicious code. We welcome good-faith security research — see the responsible disclosure invitation on our Security page.
6. Intellectual property
The site and its content (text, design, logos, software) are owned by or licensed to us. We grant you a limited, revocable, non-transferable licence to use the site for its intended personal purpose. You may not otherwise reproduce or commercialise it without our written consent.
7. Availability
We aim to keep the site available at all times but do not promise uninterrupted access; maintenance and events outside our control can cause outages. If the site is unavailable you can always reach us by email, and your legal rights (for example to give a hardship notice) are never conditional on the site working.
8. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or the National Credit Code that cannot lawfully be excluded. Subject to that, and to the extent permitted by law, we exclude liability for indirect or consequential loss arising from use of the site, and our liability for a breach of a non-excludable guarantee in relation to the site is limited, at our option, to resupplying the relevant service or paying the cost of resupply.
[LEGAL REVIEW: confirm the liability clause wording against current ACL drafting practice.]
9. Links
The site may link to third-party sites (for example our retail partner, AFCA, or the National Debt Helpline). We do not control and are not responsible for their content.
10. Privacy and communications
Our Privacy Policy explains how we handle personal information. With your recorded consent, we send documents and notices electronically to the email address on your account; keep it current and check it regularly.
11. Changes
We may update these terms from time to time. The current version, with its effective date, is always published on the site; material changes will be flagged. Continued use after a change takes effect is acceptance of the updated terms.
12. Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
